Hi all bros, need some help here and which govt can I approach. I have a g/f rom vn who have been staying with me when she is here in s'pore on 1 mth social visit pass. In fact, the flat belongs to my mum and recently there was an incident that some ICA officers came to the flat to look for overstayer or illegal immigrant in my mum's flat. At that time I was at work and she was already in vn so there is nothing to search on. We actually have a tiff with one of the neighbours staying in the same block and when she knows that I brought a foreigner gal back, she must have compliant to the ICA on that as saw her snapping photos of my gal when she is hanging clothing at the kitchen balacony.My sis make hell of the noise and want my gal who just arrived 2 days staying at my mum place to get out and want me to get out if I insist on having the gal to stay with me. Can anyone advice me if there is illegal and will the flat be confiscated if the ICA officers come to spot check? I have fallen out with my sis and will be looking to buy a 2nd hand flat this year. Fyi, the gal do not work any sideline and always stay home and we normally go out in the weekends.Do need advice which website can I turn to to prove that staying in the flat with a valid social pass is not illegal and will not affect on the confiscation of the flat.

As your girl is having valid pass and dont overstay...you dont break any law by letting stay there....to be on the safer side...the owner of the house must agree...

If u are really worry, then bring your girl and proceed to any police station and ask them on the spot...u may wish to cite the previous incident of ICA proceeding to ur house....still worried....then ask HDB....still worried then ask ICA....remember whoever u ask....remember their name...on the other hand...u may wish to ask them in writing...so that when they reply to u...it will also be in black and white

As long as not overstayer then no problem....but since flat belongs to your mum she has the final say but even if your mum report to police then all they can do is to "advise" your girl to leave that's all.....they cannot do mych to her as she is not working sideline or doing anything illegal.....they will view this as a domestic tiff.....dun fall out with family...keep tje peace 7 rent a room outside for her.....cheap cheap onli

If overstayers if you harbour them whether you intentionally or unintentionally (renting out to them without due diligence) then flat is liable to be confiscated.

It does not matter as once she's a PR as she will be accorded the same protection under the Women's Charter & Constitution similar to a Singapore citizen.

The PR status will not be automatically revoked upon a divorce, regardless of whichever party is the petitioner. It may be revoked if she has committed some criminal offence (but again depending on the severity of the offence) or some other immigration offences (e.g. lying in her PR application...etc).

As such the divorce will be handled in the same way as a Singaporean couple, albiet thru the Family & Juvenile Court at Havelock Rd. Fighting for custody will always be dependant on how the Court deems "in the best interest of the child", meaning how whom can provide best for the children both financially & emotionally.

If the man is working and the ex-wife PR is not than the man will stand a higher chance of "sole custody", if he wanted it, unless there is some misconduct on his part e.g. child abuse. Normally a joint custody will be awarded and the specific terms to be thrashed out (e.g. stay where, periods...etc).

You wrote 1 whole lump with no separate paragraph really had difficulty to read what you wrote.

Just know this fact, as long as she have not committed any offences (immigration & criminal) in Singapore, the ICA or even HDB have no right to evict her from your flat as the owners are staying there too. Overstaying is covered under immigration laws.

The HDB only have rules with regards to renting out your flat to foreigners and not for those under invitation from the owner with no financial gains involved (but of cos with the expressed permission of the owner and the owner must be staying there too)
