1) what is "Certificate of making interim judgement final (divorce)"? 2) does it means marriage dissolved after recieving it? 3) do i need to wait for any more legal paper? 4) most importantly, can i ROM again now after recieving the "Certificate of making interim judgement final (divorce)"? thanks in advance |

i am a singapore PR, i divorced with my ex-husband. i was given joint custody of my child with access to see him every week. but after a few weeks my ex-husband refused to let me see my son, i discovered tat he has moved house and i cannot located him. he refused to answer my calls also
can u please teach me how to go about finding my child? i went to the lawyer but they say without the new address they cant serve the summon to him, i went to family court, they asked my to find lawyer. wat should i do den? i appreciated if u can help me, thanks |

not very sure about the exact law as i am not a lawyer, but here are something i know about singapore law:
1: there is no marital contract, neither is there any statement valid for in the case of divorce, "we shall have our kids under who name, our house under whose name" or whatsoever, as our law suggest marriage to last forever 2: the husband have to pay anomoly when divorced, or maintenance when sperated. always. no matter if the wife fuck 100 bangla, is a billionaire or whatever. must pay, if the judge find the wrong entirely lies with wife, den the husband pay $1/month. not sure the name, but iir, its an MP or someone very tokong one... his wife killed his brother and sister in law and was charged with manslaughter. he still have to pay $1/month, and $8000 1 time payment 3: not very sure about nullifying a marriage, but i heard that the reason of nullifyiation must be the determining factor of the marriage. for example, if u marry ur wife, after that your wife get pregnant with other guy, cannot nullify. if your wife get pregnant before the marriage and u know about that, also cannot nullify. only when u dunnoe about it, think that its ur child, forced u to marry, den u realised after that, finally can nullify |

I think for null and void to be awarded, one important factor is that the couple never consummate the marriage or as the chinese put it "dong fan". But we all know that this is practically impossible as most couples would have done it long before the actual marriage. So normally they look at whether marriage has gone through the traditional solemnization. If I can recall many years back that TCS actor Wang Yu Qing got his marriage declared null and void to the gal becos they didn't go through traditional marriage.

Not all lawyers are knowledgeable on divorce matters...... there are many out there who are as blur as the layman who went to them for legal advice.
Heck..... I am a half baked kaypoh with no formal law training but I still get qualified lawyers asking me for advice when we go drinking. Get a lawyer specialising in divorce if you dun want to be screwed...... you may pay more in legal fees but you save so much more in the long term. |

Last month, the High Court ruled that a gift from a spouse during marriage is part of a couple's matrimonial assets to be divided by the court when they divorce.
The High Court made this ruling based on a claim by Mdm Tan Hwee Lee that a house in Seletar Hills was a gift to her and should not be counted among the matrimonial assets. Mdm Tan, 52, split from her husband, Mr Tan Cheng Guan, 55, after being married for 28 years. Mr Tan, an executive vice-president at SembCorp Industries, was the sole breadwinner while Mdm Tan was a housewife. (10 Oct 2011, The New Paper). |
