The victim's failure to adequately assessed the risk and exercise caution when clubbing and whatever her reason for going home with a stranger is not an invitation to rape. It does not mean that she caused what happened and to empathise with the attacker that "it’s not totally his fault” to provide reasons for leniency.

Bear in mind that a rapist is not a Victim of Opportunity. He is an Opportunist taking advantage of an easy victim. Some may argued that there may be a genuine case about consent to sex, let’s remember the fact that her alcohol level was above the toxic level which physically and mentally incapacitated her judgement and to protect herself.

Also she would not be capable of giving consent in her upset and agitated state.

This is a clear-cut case of a rape cos any guy finding himself penetrating a drunk girl is taking a very high risk of committing a sexual criminal act.

The gal agreeing to go over his place, having a sexy dance with him, & even kissing with him in the cab, definitely don't warrant an invitation to have sex with him. & the gal being so intoxicated, sure do not know who is who & what's going on. Ong's greatest punishment is not the jail or the cane, it's his failure to understand his mistake and reason out with his mental what-ever-you-call-that. He will not be a better person after the punishment and should be closely watched by the official after release.

Teacher molested and bashed up GF's younger sister
A MAN who bashed up & molested his then-gf's younger sister was jailed for 18 months on Friday.

The 29-year-old teacher, who cannot be named as there is a gag order, had admitted 2 repeatedly punching the 19-year-old girl all over & causing her 2 lose consciousness & being unable 2 follow her ordinary pursuits for 22 days.

He also admitted 2 lifting up her T-shirt exposing her chest area, removing her shorts & underwear 2 expose her lower body & touching her thighs. A 3rd charge of insulting her modesty by filming her naked lower body with his mobile was taken in2 consideration. The court heard tat the accused had been staying @ the victim's home 4 the past 2 years.

He was @ the flat @ abt noon on May 24 2010 having taken a can & bottle of beer when he tried 2 talk 2 the victim, who was asleep & ignored him. In anger, he started 2 punch her all over. She tried 2 get up & struggled but he punched & kicked her on her upper thigh.

When she fell on the floor unconscious, he lifted up her T-shirt, removed his bermudas 2 expose himself, removed her shorts & underwear & touched her thighs & legs. He sat & stared @ her exposed lower body & left the room aft a while.

The victim's father happened 2 come home & when he found her lying on the floor, he thought she had been raped & called the police. The victim was warded in the high dependency ward 4 multiple bruises, abrasions & scratch marks as well as bleeding in the eyes & ears. She was also given 22 days of hospitalisation leave.

Youth, 16, raped 14-year-old step-sister

A 16-YEAR-OLD was on wkend leave fr a welfare home when he raped his step-sister in 2009.

The youth, now 18, did it 4 times in all when she was 14 & 15, @ their home in the east. As a result, the girl became pregnant & delivered a baby girl in January 2010. The infant has been fostered out.

A Community Court heard on Friday tat the victim & her 9-year-old half-brother were watching television @ home 1 night in February 2009 when the accused started disturbing her by hitting her on the arms. She hit him back in a playful manner as they had done, when they were young.

DPP Gail Wong said the accused suddenly felt an urge 2 hv sex with the victim. He caught hold of her, pulled her in2 the bedroom & locked the door.

The victim shouted @ her half-brother 2 take the spare keys & open the door. The accused then stood @ the door 2 prevent her fr leaving. He also opened the door & took away the keys fr their half-brother & told him not 2 disturb. He raped her. He raped her again the following month.

The girl was 2 ashamed 2 tell her parents. The offences came 2 light in October 2009 when she revealed 2 a school counsellor wat her step-brother had done. The accused, who had 2 other charges taken in2 consideration, will be sentenced on April 20. The maximum penalty 4 rape is 20 years, a fine or caning.

He committed offence 4 times; girl was 14 when 1st raped & gave birth last year

A YOUTH who raped his step-sister on 4 occasions was jailed for 10 years & ordered 2 be given 12 strokes of the cane yesterday.

The girl, aged 14 @ the time of the 1st rape, had not told her family as she felt ashamed of wat had happened. She gave birth 2 a girl early last year & the child has since been fostered out.

The accused, now 18, pleaded guilty 2 2 counts of rape in February & March in 2009 & the other 2 charges were considered during sentencing. He cannot be named 2 protect the girl’s identity.

The pair had been living in the same household since 1997 when the victim’s father married the accused’s mother. They hv a younger half-brother.

Arguing 4 an appropriate jail term & caning, DPP Gail Wong said the girl was just 14 when she was 1st sexually assaulted by her step-brother, then 16.

She said the accused had failed 2 protect his step-sister & betrayed the trust. He repeatedly committed the rapes over a few months with some degree of force used, she added.

The court heard tat the accused returned 2 his Bedok North flat fr a juvenile home tat weekend in February 2009. A Juvenile Court had sentenced him 2 stay in a juvenile home for 2 years fr November 2007 4 rioting.

In his oral grounds of decision, Community Court Judge Ng Peng Hong said the accused – assessed 2 be simplistic in his thinking – was a recalcitrant.

He agreed with the DPP tat the accused was undeterred by the Juvenile Court’s rehabilitative sentence, & tat a deterrent punishment was needed. The offences were not isolated incidents but a “persistent course of reprehensible conduct”, he added.

The judge did not give much weight 2 the victim’s undated letter of forgiveness & appeal 4 leniency as she was young & might not appreciate the seriousness of the matter. “I also caution myself tat the victim might hv written the letter out of fear & pressure fr the family,” he added.

The 16-year-old girl is not currently schooling.

The accused’s lawyer Josephus Tan had asked 4 a 2nd chance 4 his client thru a stint in reformative training. He said the entire judicial process had taught the accused a very bitter & traumatic lesson in tat he now had 2 shoulder the disappointments of his family & the shame of his actions.

The accused could hv been jailed 4 up to 20 years, fined or caned on each charge.

Salesman sexually abused stepdaughter, 8 28 Apr 2011

A SALESMAN was convicted yesterday of sexually abusing his 8-year-old stepdaughter.

The 30-year-old had claimed in court tat the girl was prone 2 telling lies. But District Judge Toh Yung Cheong said he found her 2 be an “unusually convincing” witness becos of the consistency of her evidence & her demeanour on the witness stand.

The judge also pointed out tat the credibility of the stepfather had been undermined becos of “material inconsistencies” betw his statements 2 the police & the testimony he delivered in court. Judge Toh did not elaborate.

The stepfather will be sentenced on Friday & faces a jail term of up to 10 years & a fine of up to $10,000 on each of the 3 charges he was convicted of.

16 similar charges hv been stood down.

Defence counsel Goh Aik Chew said tat he had been instructed 2 appeal against the conviction.

During the 10-day trial tat started in February, the court heard tat the 3 offences were committed betw Jan 27 & Oct 2, 2009. 1 occurred in the bathroom while 2 took place in the bedroom of the 1-room flat.

The girl, who was then living with her 2-year-old brother, her sales assistant mother, stepfather & grandmother, cannot be named 2 protect her identity.

She was the main witness 4 the prosecution but testified in-camera, which meant tat the courtroom was cleared of the public & the media.

However, the testimony of her mother, grandmother, school counsellor & social workers shed light on how the offences were discovered.

The girl told her grandmother about the abuse on Sept 27, 2009.

3 days later, the grandmother told the girl’s mother.

The mother wanted 2 be sure b4 going 2 the authorities, but the girl confided in her school counsellor on Oct 2 the same year.

The counsellor told the court tat she was shocked 2 hear the primary school pupil describe how her stepfather forced her 2 perform sex acts & got on top of her.

Officers fr the MCD, Youth & Sports were notified & a senior child protection officer testified tat the girl also accused her stepfather of forcing her 2 watch “Japanese girls movies” with scenes of skimpily dressed actresses.

Tis forms 1 of the 16 remaining charges.

Although worried tat her mother & grandmother would be upset, the girl told the officer tat “she could not take it anymore & she just wanted the bad things 2 stop”.

The officer said tat the girl had said: “It is the worst thing I’ve ever done in my life.”

The girl is now being cared 4 in a children’s home.

The stepfather is out on $10,000 bail.

Dad, uncle beat up 14-year-old girl's BF for allegedly leading her astray 29 Apr 2011

THE father beat up a full-time national serviceman (NSF) in a Choa Chu Kang cemetery 4 allegedly leading his 14-year-old daughter astray.

Her uncle – the dad’s younger brother – was also involved in the assault 2 years ago tat featured a baton & a samurai sword.

Yesterday, the 2 men were each jailed a year & 8 months by District Judge Sarjit Singh 4 being part of an unlawful assembly tat had attacked Mr Lee Poh Kiang, now 19, with deadly weapons, hurting him, abducting & taking him by force 2 the cemetery.

The judge observed tat the attack was “an emotional response” by the 2 men who thought they were protecting the girl fr bad influence. The duo were convicted on April 7 after a 3-week trial.

Asking the court not 2 impose a crushing sentence, defence counsel Subhas Anandan said the 2 men sincerely believed Mr Lee had instigated the girl 2 run away fr home.

They also suspected tat she had sniffed glue & had sex with him. The lawyer added that these suspicions resulted in the 2 men setting upon the NSF 2 dissuade him fr continuing the relationship.

The father, 43, & uncle, 38, who cannot be named 2 protect the minor’s identity, r appealing against their conviction.

Urging the court 2 teach the 2 men a lesson 4 taking the law in2 their own hands, Deputy Public Prosecutor Shahla Iqbal pointed out tat the assault started when the 2 men & their 2 accomplices saw Mr Lee & his gf walking along Ang Mo Kio Avenue 3 @ 12.30am on May 29, 2009.

The victim was dragged by his hair in2 a Honda Stream driven by the father. She said the attackers also used weapons such as a baton & a samurai sword @ the cemetery where 2 more accomplices turned up.

For being a member of an unlawful assembly tat had used deadly weapons, the father & uncle could hv been jailed up to 10 years & caned. The maximum sentence 4 causing hurt is a 2-year jail term & a $5,000 fine, while tat 4 abduction is a 7-year jail term & a $10,000 fine.

They could also hv been caned.

Another charge of perverting the course of justice has been stood down. It is alleged tat when Mr Lee reported them 2 the police, the father & uncle took him 2 a karaoke lounge, plied him with drinks & hostesses, & tried 2 get him 2 change his police statements.

Cleaner molested stepdaughter, 8 and sis-in-law, 14 - 12 May 2011

A CLEANER who molested his 8-year-old stepdaughter & sister-in-law aged 14 was sentenced 2 nearly 9 years’ jail & 9 strokes of the cane yesterday.

The 39-year-old, who cannot be named 2 avoid identifying his victims, abused both children separately while they were watching television.

District Judge Jasbendar Kaur called his conduct reprehensible. “Not only r your victims young, but they r also children who r related 2 you,” she said.

“You basically took advantage of these defenceless children in their own home, where I m sure u agree tat they, as children, should feel safe.”

The cleaner received the 105-month sentence aft pleading guilty last month 2 taking morphine & 2 charges of molestation.

DPP John Lu told the court tat the 14-year-old secondary school student was lying on the couch watching TV & talking on the phone in the early hours of May 9 last year.

The accused told her not 2 stay up 2 late, & stroked her thigh in an up-down motion.

She immediately pulled away in shock. He walked off but turned back suddenly & kissed her on the cheek. When he tried 2 kiss her lips, she pushed him away.

2 days later, he molested his 8-year-old stepdaughter while she was watching TV in the living room.

Shocked by his actions, she pushed him away & told him not 2 disturb her. She left & joined her 2 brothers, who were playing along the common corridor.

Investigations showed the accused had also touched the girl improperly on other occasions.

Both girls made separate police reports in May & June last year.

The stepfather, a repeat drug offender, was arrested @ the void deck of his housing block on Feb 22 on suspicion of having taken drugs. The urine sample he gave was analysed & found 2 contain morphine.

Man jailed for underage sex; girl now has baby son - 12 May 2011

A WEEK aft they met in 2009, a man took a teenage girl 2 a staircase landing in Bukit Batok Central, where they had sex.

The girl, then a month shy of her 16th birthday, gave birth 2 a boy in March last year, & is now caring 4 the baby. A paternity test has shown the accused 2 be the baby’s biological father.

The unemployed man, aged 25, was jailed on Tuesday for 2 weeks & fined $8,000 for having sex with a girl below 16 in August 2009. He did not pay the fine & will thus serve 4 weeks in jail.

DPP Toh Puay San said the day the couple met thru a mutual friend, the girl was in her school uniform. Over lunch, she told him she was 16.

Aft lunch, he took her home 2 change as she had a part-time job. He also asked her 2 be his girlfriend.

Later tat day, in the middle of her shift, they went 2 a staircase landing in Block 628, Bukit Batok Central 2 talk & kiss.

A week later, he asked her out on the pretext of giving her something; they went 2 a staircase landing & had sex.

DPP Toh said tat in January last year, the girl’s supervisor asked her if she was pregnant. She denied it, but a test told her otherwise.

When she told the accused she was carrying his baby, he did not believe her & asked her who the father was & who else she had slept with.

He could hv been jailed 4 up 2 5 years & fined up to $10,000 for the offence.

Serial molester faces 73 charges - 14 May 2011

AN ALLEGED serial molester has been charged with 73 counts of molestation & 2 other offences.

Postman Abdul Razak Hamid's alleged offences date back 2 as far back as 20 years ago when he was 32.

Now 52, he is alleged 2 hv molested girls aged five to 11 in various parts of Singapore @ mostly staircase landings & void decks near 2 the letterboxes.

He surrendered himself 2 the police on April 27 following a police appeal 4 information of 2 outrage of modesty cases involving 2 young female victims.

At times, the victims were allegedly molested by him more than 1s. In some cases, he molested siblings.

He was remanded @ IMH 4 psychiatric examination.

His next court date is May 27.

I really did not know in detail as we did not read or get to see what is the Charges about,only get to know from his side of the story and being charge . But this is a true story which happen in somewhere 2002 .

Like many bros had said, no one know what really happen better than both of them....
